This notice explains how we collect, use, store and share personal information when you use our website, register with JEER, work through or provide services through JEER, contact us, or otherwise interact with us.

Information we collect

Depending on your relationship with JEER, we may collect:

  • your name, address, date of birth and contact details;

  • National Insurance number, Unique Taxpayer Reference, tax and VAT information;

  • company name, Companies House number and other business information;

  • nationality and information required for identity, eligibility or right-to-work checks;

  • job title, trade, qualifications, skills and assignment details;

  • information about how an assignment will operate, including supervision, training and working arrangements;

  • bank account and payment details;

  • identification and supporting documents;

  • CSCS or other relevant professional, trade or competency information;

  • information about adjustments or support you may require;

  • communications with us and records of support provided;

  • information relating to payments, contracts, assessments and engagement administration; and

  • technical information generated when you use our website.

We will only collect information that is reasonably necessary for the relevant purpose.

Where we obtain information

We may collect information directly from you.

We may also receive information from recruitment agencies, clients, contractors, businesses referring you to JEER, previous service providers where a lawful data migration or transfer has taken place, and relevant third-party systems or service providers.

Where information is obtained from another source, we will handle it in accordance with applicable data protection law.

How we use your information

We may use personal information to:

  • assess and administer contractor and worker engagements;

  • verify identity and relevant eligibility or compliance requirements;

  • assess appropriate engagement and payment arrangements;

  • set up and maintain records within our contractor-management systems;

  • prepare, issue and administer contracts and onboarding documentation;

  • process payments and maintain appropriate financial and tax records;

  • communicate with you, our clients and relevant agencies;

  • provide contractor support;

  • comply with tax, regulatory, reporting and other legal obligations;

  • prevent fraud, misuse and security incidents;

  • maintain appropriate business and compliance records;

  • establish, exercise or defend legal claims; and

  • improve and administer our services.

Our lawful bases

We process personal information only where we have an appropriate lawful basis.

Depending on the circumstances, this may include:

Contract
Where processing is necessary to take steps at your request before entering into an agreement or to perform an agreement with you.

Legal obligation
Where we need to process information to meet tax, employment, regulatory, reporting, identity or other legal requirements.

Legitimate interests
Where processing is reasonably necessary to operate JEER, administer engagements, maintain accurate records, protect our business, prevent fraud, support clients and contractors or establish and defend legal rights, provided those interests are not overridden by your rights.

Consent
Where consent is the appropriate lawful basis, for example for certain optional communications. Where we rely on consent, you may withdraw it at any time.

We do not rely on consent simply because you are completing a registration form. ICO guidance makes clear that organisations should identify the lawful basis that genuinely applies rather than treating consent as the default.

Sensitive and special-category information

Certain information, including information concerning health, is subject to additional legal protection.

JEER will only process such information where it is necessary, proportionate and permitted under the UK GDPR and Data Protection Act 2018.

For example, we may need limited information about reasonable adjustments or job-specific fitness requirements. We will seek to collect the minimum information necessary for the relevant purpose.

Special-category information requires both an ordinary lawful basis and an additional condition under Article 9 of the UK GDPR.

Sharing information

We may share personal information where reasonably necessary with:

  • the recruitment agency, contractor or business through which an engagement has been arranged;

  • the client or end user receiving the services;

  • payroll, contractor-management and onboarding service providers;

  • My Digital Accounts and other systems used to administer engagements;

  • electronic signature and document-management providers;

  • banks and payment service providers;

  • approved professional advisers and specialist partners where relevant;

  • IT, website, email, hosting and secure-storage providers;

  • HM Revenue & Customs and other government, regulatory or law-enforcement bodies where required; and

  • professional advisers, insurers or legal representatives where necessary.

We do not sell personal information.

Where an optional service is provided by an approved specialist partner, we will only share information that is reasonably necessary for that purpose and will explain the arrangement where appropriate.

International processing

Some of the technology and service providers we use may process or store information outside the United Kingdom.

Where personal information is transferred internationally, we will take reasonable steps to ensure that an appropriate lawful transfer mechanism and safeguards are in place.

How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet legal, tax, regulatory, contractual and dispute-resolution requirements.

Different records may therefore have different retention periods.

For example, HMRC requires certain employment intermediary records to be retained for at least three years after the end of the relevant tax year.

Where information is no longer required, it will be securely deleted, anonymised or otherwise disposed of in accordance with our retention arrangements.

Security

We use appropriate technical and organisational measures designed to protect personal information against unauthorised access, disclosure, loss, alteration or misuse.

Access to personal information is restricted to people who need it for legitimate business purposes.

No internet-based system is completely secure, but we regularly review the systems and processes used to handle personal information.

Automated processing

We may use technology to support onboarding, compliance checks, workflow and record management.

We do not currently rely solely on automated decision-making to make decisions that have legal or similarly significant effects on individuals. Where systems identify an issue requiring judgement, the matter is reviewed by an authorised person.

Your rights

Depending on the circumstances, UK data protection law may give you the right to:

  • access personal information we hold about you;

  • ask us to correct inaccurate or incomplete information;

  • ask us to erase information in certain circumstances;

  • restrict how we use information;

  • object to certain processing;

  • receive certain information in a portable format;

  • withdraw consent where processing is based on consent; and

  • raise concerns about how your information is being handled.
